Is Spousal Maintenance Mandatory in Illinois?

No, unlike child support, spousal maintenance is not automatically granted after a divorce. In Illinois, a judge will consider several factors before deciding whether alimony is appropriate in your case.

Common factors in this decision include:

  • Annual net income of each spouse
  • The length of the marriage
  • The standard of living in the marriage
  • The health of each spouse
  • The job skills and earning potential of each spouse

Estimating Spousal Maintenance in Wheaton

While every divorce is unique, a rough estimate of spousal maintenance can be calculated by taking 33% of the paying spouse’s net income and subtracting 25% of the receiving spouse’s income. This figure is divided by 12 to estimate monthly alimony payments. However, the court will not allow the annual amount to exceed 40% of the combined net income of both spouses. Keep in mind, the court will weigh many additional factors in determining alimony.

Types of Spousal Maintenance

There are three main types of spousal maintenance in Illinois:

Temporary

Paid during the divorce process to prevent one spouse from facing financial hardship.

Short-Term

For spouses who need time to become self-sufficient, such as while completing education or training.

Permanent

Often awarded in marriages lasting 20 years or more, potentially for the length of the marriage or for life.
